1. Welcome to This That Those and These

These Terms and Conditions (“Terms”) govern your use of the This That Those and These marketplace (“Platform,” “we,” “us,” or “our”). By accessing or using our website, you agree to be bound by these Terms.

2. Our Role as a Marketplace

IMPORTANT: We Are a Platform, Not a Seller

This That Those and These is a multi-vendor marketplace that connects buyers with independent sellers (“Vendors”). We are NOT the seller, manufacturer, or distributor of the products listed on this Platform unless explicitly stated otherwise.

  • We do not inspect, verify, or guarantee the quality, safety, or legality of items listed by Vendors
  • We do not store, handle, or ship products sold by Vendors
  • We are not responsible for product descriptions, pricing accuracy, or inventory levels set by Vendors
  • All transactions occur between you and the Vendor

3. Buying on Our Platform

3.1 Placing Orders

When you purchase from a Vendor on our Platform:

  • You are entering into a contract directly with that Vendor
  • We facilitate payment processing and collect a 10% commission on each sale
  • The Vendor is responsible for fulfilling your order (packaging, shipping, delivery)

3.2 Pricing

  • All prices are set by individual Vendors
  • Prices are listed in USD (United States Dollars)
  • We reserve the right to correct pricing errors

3.3 Payment

  • We use Stripe for secure payment processing
  • Payment is processed at the time of purchase
  • We hold funds and distribute payments to Vendors according to our withdrawal policy

3.4 Local Pickup & Authorized Hubs

What Are Authorized Hubs? Authorized Hubs are physical locations where:

  • Buyers can pick up large or local items
  • Vendors can leave items on consignment for sale
  • Items are stored securely until sold or picked up

How It Works:

  1. Vendor lists item and selects “Local Pickup” or “Consignment at Hub”
  2. Buyer purchases and selects their preferred pickup hub
  3. Vendor delivers item to the hub (or it’s already there on consignment)
  4. Buyer picks up from hub with valid ID and order confirmation

Additional authorized hubs may be added. Available hubs will be shown at checkout.

4. Returns, Refunds, and Disputes

4.1 Vendor Responsibility

Each Vendor sets their own return and refund policies, which should be clearly stated on their product pages.

4.2 Dispute Resolution

If you have an issue with a purchase:

  1. Contact the Vendor first through our messaging system
  2. If unresolved within 7 business days, contact us at [support@thisthatthoseandthese.com]
  3. We will mediate the dispute but cannot guarantee outcomes
  4. For payment disputes, you may contact Stripe directly

4.3 Our Liability

To the maximum extent permitted by law:

  • We are not liable for any damages arising from Vendor products or services
  • Our total liability to you is limited to the amount of commission we collected from the transaction
  • We are not responsible for shipping delays, lost packages, or damaged items (these are Vendor responsibilities)

4.4 Consignment Items

Consignment Terms: When Vendors leave items at an Authorized Hub on consignment:

  • Ownership: Vendor retains ownership until item is sold
  • Commission: We charge our standard 10% platform commission PLUS a consignment fee of 5%
  • Storage Period: Items may be stored for up to [90 days]. Unsold items after this period will be returned to Vendor or donated at your discretion
  • Pricing: Vendor sets the price. Hub operators may suggest price adjustments after 30 days if item hasn’t sold
  • Payment: Vendor receives payment within 7 days of sale, minus all commissions and fees

Risk of Loss or Damage:

  • Before Sale: Vendor assumes all risk of loss, theft, or damage while item is at hub
  • Insurance: We recommend Vendors maintain their own insurance for consigned items
  • Our Liability: Maximum liability for lost/damaged consignment items is 50% of the listed price

Item Removal: We reserve the right to:

  • Remove items that violate our policies
  • Reduce prices on items unsold after 30 days (with Vendor notification)
  • Donate or dispose of unsold items after the storage period expires
  • Charge a removal fee of Storage cost if Vendor requests item return before sale

4.5 Local Pickup Terms

Pickup Requirements:

  • Valid government-issued photo ID required
  • Order confirmation number (email or printed)
  • Pickup must occur within 7 days of purchase notification
  • Items not picked up within 7 days may be returned to Vendor, and buyer may forfeit refund

After Pickup:

  • All sales are final once item leaves the hub
  • Buyer acknowledges they have inspected the item and accept it “as-is”
  • No returns or refunds on local pickup items unless item was materially misrepresented

Hub Operator Rights: Hub operators reserve the right to:

  • Refuse service to anyone
  • Require additional verification for high-value items
  • Hold items for additional verification if fraud is suspected
  • Charge a storage fee of $1/day after the 7-day pickup window

4.6 Authorized Hub Operators

Becoming a Hub Operator: Individuals or businesses may apply to become Authorized Hub partners. Requirements include:

  • Secure physical location with business hours
  • Valid business license (if applicable)
  • Agreement to Hub Operator Terms (separate document)
  • Background check (for individual operators)

Hub Operator Responsibilities:

  • Securely store consignment items
  • Verify buyer identity at pickup
  • Facilitate item inspections before pickup
  • Notify platform of any issues (damage, theft, disputes)
  • Maintain professional customer service

Hub Operator Compensation: Hub operators receive 5% of sales from items picked up or consigned at their location


5. Prohibited Items and Activities

Vendors may NOT list:

  • Illegal items or stolen goods
  • Counterfeit or fake products
  • Weapons, firearms, or explosives
  • Illegal drugs or drug paraphernalia
  • Hazardous materials
  • Adult content or obscene materials
  • Items that violate intellectual property rights
  • Any items that violate local, state, or federal laws

We reserve the right to remove any listing at our discretion.

6. Vendor Accounts

6.1 Becoming a Vendor

To sell on our Platform, you must:

  • Create a Vendor account and complete registration
  • Agree to these Terms and our Vendor Agreement
  • Provide accurate business and contact information
  • Connect a valid Stripe account for payments

6.2 Vendor Responsibilities

Vendors agree to:

  • Accurately describe products and condition
  • Ship items within stated timeframes
  • Respond to customer inquiries within 48 hours
  • Honor return and refund policies as stated
  • Comply with all applicable laws
  • Pay our 10% commission on all sales

6.3 Payouts

  • Vendors may request withdrawals when their balance meets the minimum threshold
  • Withdrawals are processed within 2-7 business days
  • We reserve the right to hold funds for up to 30 days for new Vendors or suspicious activity
  • Vendors are responsible for their own taxes

6.4 Account Termination

We may suspend or terminate Vendor accounts for:

  • Violating these Terms
  • Selling prohibited items
  • Excessive customer complaints
  • Fraudulent activity
  • Inactivity (no sales for 12 months)

7. User Accounts

7.1 Account Security

  • You are responsible for maintaining the confidentiality of your account
  • You agree to notify us immediately of any unauthorized access
  • We are not liable for any loss from unauthorized account access

7.2 Prohibited Use

You may not:

  • Create multiple accounts to abuse the system
  • Use automated bots or scripts
  • Harass Vendors or other users
  • Attempt to circumvent our security measures
  • Use the Platform for any illegal purpose

8. Intellectual Property

  • Our website design, logo, and content are owned by This That Those and These
  • Vendors retain ownership of their product listings but grant us license to display them
  • You may not copy, reproduce, or redistribute our Platform without permission

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • WE PROVIDE THE PLATFORM “AS IS” WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT OF COMMISSION WE COLLECTED FROM THE TRANSACTION IN QUESTION
  • WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION

10. Indemnification

You agree to indemnify and hold harmless This That Those and These, its owners, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your interaction with Vendors or buyers
  • Your violation of any third-party rights

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or website notice. Continued use of the Platform constitutes acceptance of updated Terms.

12. Governing Law

These Terms shall be governed by the laws of Oklahoma United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Lindsay Oklahoma.
